Is CBD Oil Legal?

CBD oil derived from the hemp plant is legal in all 50 states.  Here is why:

Hemp vs Marijuana

1CBD oil made from hemp has no psychoactive effects, and that is where there is a misunderstanding. In reality, hemp and marijuana are the same exact plant. There are different strains of the plant with more or less THC. There is also a difference in how the plants are produced. Hemp is really fibrous, with long strong stalks and has very few flowering buds. Marijuana is smaller in size, bushier and filled with blooming buds. Marijuana also has a really low quantity of CBD. Hemp has a naturally high quantity of CBD and a small trace amount of THC.

2The Industrial Hemp Farming Act is the law you want to know.  The legal definition of commercial hemp (which is the plant from which our CBD oil is made) per Section 7606 of the Agricultural Appropriations Act of 2014, is INDUSTRIAL HEMP. The term “industrial hemp” indicates the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis”.
